Welcome to Custom Song Souvenirs. Please read these terms carefully as they govern your use of our services and purchase of custom songs. By placing an order, you agree to these terms.
1. Our Services
We create and deliver custom, personalized songs based on the information you provide. All songs are delivered digitally in the form of an MP3 or WAV via email. No physical product will be shipped.
2. Orders and Customization
Once you place an order, we’ll use the details you provide (names, stories, style, etc.) to write and produce your custom song. Please check your information carefully before submitting; we are not responsible for spelling errors, incorrect names, or other mistakes you submit. We reserve the right to decline or cancel an order if it contains inappropriate, illegal, or hateful content.
3. Delivery
Digital delivery will typically occur within 1 week from receiving your completed order form and payment. Delivery is made via the email address you provide. Please ensure your email address is correct. Once your digital file is sent, the product is considered delivered and fulfilled.
4. Returns, Refunds, and Revisions
Because our songs are custom-made, all sales are final and non-refundable once work has begun. However, we want you to love your song!
We offer: One (1) round of minor edits within 7 days of delivery. Major changes (full rewrite, different genre) will incur an additional fee of $89.00.
5. License and Usage Rights
When you purchase a custom song: You receive a personal, non-exclusive license to use and share the song for personal purposes (listening, gifting, sharing on social media). We retain all copyrights to the music and lyrics unless otherwise agreed in writing. You may not resell, redistribute, or use the song for commercial purposes (ads, streaming revenue, public broadcast) without our written permission. We may feature snippets or anonymized examples of songs we create (never including private information) for promotional use.
6. Payments
All prices are in USD and must be paid in full before production begins. Payments are processed securely through Stripe. We do not store or have access to your payment information.
7. Intellectual Property
All lyrics, music, recordings, and related materials are protected by copyright law. You may not reproduce, modify, or claim ownership of our intellectual property.
8. Privacy
Your privacy matters to us. We collect and use your information only to fulfill your order and communicate with you about our services. We may use the song we created for you for promotional purposes. We will never share any other personal information provided.
9. Limitation of Liability
We make every effort to ensure your satisfaction, but we are not responsible for: Technical issues with file downloads or email delivery beyond our control. Losses or damages resulting from misuse or inability to access the digital files. Our total liability shall not exceed the amount you paid for your song.
10. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on our website with an updated effective date.
